Please read this document carefully before signing. By executing this document, You, the Parent/Legal Guardian grants consent for the participation of your Child/Ward who is a minor, in the Study Tour organised by SANCHARAM EXPLORATIONS PRIVATE LIMITED, having its registered office at Labour India Complex Marangattupilly P O, Marangattupilly, Kottayam, Kerala, India, 686635 (“Sancharam”), authorises emergency medical treatment in specified circumstances, acknowledges the inherent risks associated with travel, and agrees to the terms and conditions contained herein. You may use our services only if you unconditionally agree to these terms. On execution, this becomes a valid contract which is legally binding.
1.1. I/We hereby declare that I/we am/are the natural parent(s) or lawful guardian(s) of the Student named in this Agreement and possess full legal authority to provide this consent.
1.2. I/We voluntarily and unconditionally consent to the participation of the Student in the study tour organised by Sancharam, including all educational, cultural, recreational and travel-related activities forming part of the itinerary.
1.3. I/We further authorise the Student to travel by air, rail, road, water or any other mode of transport arranged by Sancharam or its authorised service providers for the purposes of the Study Tour.
1.4. Where the Study Tour involves international travel, I/We further authorise Sancharam and its authorised representatives to present this Consent, together with any other supporting documents, before immigration authorities, customs authorities, airlines, embassies, consulates or other governmental authorities as may be required for facilitating the Student’s travel.
2.1. I/We acknowledge that the Student shall remain under the supervision of responsible adults during the Study Tour.
2.2. Where teachers or authorised representatives from the Student’s school accompany the Study Tour, such persons shall supervise the Student during the Tour.
2.3. In the event that teachers or authorised representatives from the Student’s school do not accompany the Study Tour, I/We expressly consent to the Student being supervised by teachers, tour coordinators, escorts, or other authorised representatives appointed by Sancharam for the duration of the Study Tour.
2.4. I/We authorise such accompanying personnel to exercise reasonable supervision and make day-to-day decisions concerning the Student’s participation, safety, discipline and welfare during the Study Tour.
3.1. In the event of an accident, illness or any medical emergency affecting the Student during the Study Tour, and where I/we cannot be contacted despite reasonable efforts by Sancharam, I/we hereby authorise Sancharam, its authorised representatives, accompanying teachers and tour coordinators to:
a. arrange for first aid, emergency medical treatment, hospitalisation, surgery, diagnostic procedures or any other medical treatment considered reasonably necessary by a registered medical practitioner;
b. execute hospital admission forms, medical consent forms or other documents required by hospitals or medical facilities solely for the purpose of securing emergency medical treatment for the Student;
c. arrange emergency transportation or medical evacuation where considered reasonably necessary.
3.2. I/We acknowledge that in circumstances involving immediate risk to the Student’s life, health or safety where communication with me/us is not reasonably possible, Sancharam and its authorised representatives may take such reasonable decisions as are considered necessary for the Student’s protection and welfare. I/We agree that such decisions, when taken in good faith and in the best interests of the Student, shall not give rise to any claim against Sancharam except where such decision results from negligence or willful misconduct.
3.3. I/We agree to bear and promptly reimburse all medical expenses, hospital charges, ambulance charges, medicines, evacuation expenses and all other costs incurred in connection with such medical treatment, except to the extent covered under any insurance arranged for the Study Tour.
4.1. I/We confirm that I/we have truthfully disclosed all known medical conditions, allergies, dietary restrictions, medications, physical limitations or special care requirements relating to the Student.
4.2. I/We undertake to immediately inform Sancharam of any material change in the Student’s medical condition before commencement of the Study Tour.
4.3. I/We understand and acknowledge that Sancharam shall not be held responsible for any consequences arising from incomplete, inaccurate or non-disclosure of the Student’s medical information.
5.1. I/We acknowledge that the Student shall comply with:
a. all applicable laws of the places visited;
b. the rules and regulations of transport operators, hotels, educational institutions and other venues;
c. the instructions issued by accompanying teachers, tour coordinators and authorised representatives of Sancharam;
d. the Code of Conduct communicated by Sancharam or the participating school.
5.2. I/We understand that serious misconduct, including but not limited to violence, bullying, vandalism, theft, possession or consumption of alcohol, tobacco, narcotic drugs or prohibited substances, carrying prohibited items, harassment, willful disobedience, behaviour endangering the safety of any person, or any unlawful act, may result in disciplinary action.
5.3. I/We understand that Sancharam may, after informing me/us and the participating school wherever reasonably practicable, require the Student to discontinue participation in the Study Tour if such action is considered necessary in the interest of safety, discipline or compliance with law, and where early return of the Student becomes necessary due to the Student’s misconduct, all resulting travel, accommodation and associated costs shall be borne by me/us, and any refund shall be subject to Sancharam’s cancellation and refund policy.
6.1. I/We hereby grant permission to Sancharam, its authorised representatives and photographers/videographers engaged by Sancharam to photograph, film or otherwise record the Student during the Study Tour.
6.2. I/We further authorise Sancharam to use such photographs, videos or recordings, with or without the Student’s name, for legitimate educational, promotional, marketing, archival, social media, website, brochure or publicity purposes, without payment of any royalty or other compensation.
6.3. I/We understands that Sancharam shall ensure that such use is appropriate, lawful and does not intentionally portray the Student in a derogatory, misleading or defamatory manner.
7.1. I/We acknowledge that Sancharam will collect, store, process and use the personal information of the Student and the Parent/Guardian, including identity details, contact information, medical information, emergency contact details, location details and travel-related documents, solely for the purposes of organising, administering and conducting the Study Tour and complying with applicable legal and regulatory requirements.
7.2. I/We expressly consent to such processing and to the sharing of such information, only to the extent reasonably necessary, with airlines, transport operators, hotels, educational institutions, insurance providers, medical facilities, government authorities, visa agencies and other service providers engaged for the Study Tour.
7.3. I/We understands that Sancharam shall process such personal data in accordance with the applicable laws of India, including the provisions of the Digital Personal Data Protection Act, 2023, and shall implement reasonable security measures to protect such information.
8.1. I/We understand that educational travel necessarily involves certain inherent risks, and voluntarily acknowledge and accept these inherent risks on behalf of the Student, including but not limited to:
a. delays, cancellations or changes in transportation schedules;
b. adverse weather conditions;
c. accidents despite reasonable care;
d. illness or communicable diseases;
e. natural disasters;
f. political disturbances or civil unrest;
g. theft, loss of personal belongings; and
h. risks ordinarily associated with domestic or international travel.
9.1. I/We acknowledge that Sancharam has informed me/us whether travel and medical insurance is included as part of the Study Tour package.
9.2. Where insurance is included, I/We understand that the insurance shall be governed exclusively by the terms, conditions, exclusions and limitations of the insurance policy issued by the insurer.
9.3. Where insurance is not included, I/We acknowledge that it is my/our responsibility to arrange suitable travel and medical insurance for the Student, if considered necessary.
9.4. I/We further understand that Sancharam does not represent or warrant that any insurance policy provides complete protection against all risks, losses or expenses arising during the Study Tour.
10.1. I/We acknowledge that the itinerary provided by Sancharam is indicative and may require modification due to weather conditions, transportation disruptions, government directions, safety considerations, operational requirements, force majeure events, availability of attractions or other circumstances beyond the reasonable control of Sancharam.
10.2. I/We authorise Sancharam to make such reasonable changes, substitutions, rescheduling or cancellations as may be necessary in the interests of the safety, security, welfare or overall management of the Study Tour.
10.3. I/We further understand that Sancharam shall endeavour to inform me/us and the participating school of any material changes as soon as reasonably practicable. Such changes shall not, by themselves, constitute a breach of the terms or entitle the Parent/Guardian to any refund or compensation, except where otherwise expressly provided by Sancharam’s applicable booking or cancellation policy.
I/We understand and acknowledge that
11.1. Sancharam shall exercise reasonable care in organising and conducting the Study Tour. However, to the maximum extent permitted under applicable Indian law, Sancharam shall not be liable for any injury, illness, loss, damage, delay, inconvenience or expense arising from:
a. acts or omissions of independent airlines, transport operators, hotels, restaurants, hospitals or other third-party service providers;
b. force majeure events including natural disasters, pandemics, governmental restrictions, strikes, civil disturbances or other events beyond the reasonable control of Sancharam;
c. failure of the Student to follow lawful instructions or safety directions;
d. any pre-existing medical condition or undisclosed medical condition of the Student; or
e. loss of personal belongings unless directly caused by Sancharam’s negligence.
11.2. Nothing contained in this Agreement shall exclude or limit liability for fraud, wilful misconduct or negligence where such exclusion is not permissible under applicable law.
12.1. I/We agree to indemnify and keep indemnified Sancharam, its directors, officers, employees, tour coordinators, accompanying teachers, authorised representatives and agents against any losses, damages, liabilities, costs or expenses arising from the following, except to the extent that such liability arises solely due to the negligence or wilful misconduct of Sancharam or its employees:
a. any breach of this Agreement by me/us or the Student;
b. any wilful misconduct or unlawful act committed by the Student during the Study Tour; or
c. any claim made by a third party arising from the Student’s acts or omissions.
I/We agree that any interpretation and terms pertaining to this declaration shall be governed by and construed in accordance with the laws of India. The courts at Kottayam, Kerala shall have exclusive jurisdiction to adjudicate any disputes arising out of or relating to this declaration.
